Uniform Complaint Procedures

A uniform complaint is a written and signed statement alleging a violation of federal or state laws or regulations, which may include an allegation of unlawful discrimination, harassment, intimidation, or bullying. If the complainant is unable to put the complaint in writing, due to conditions such as a disability or illiteracy, the agency shall assist the complainant in the filing of the complaint. This procedure should be used for sexual harassment/discriminatory bullying cases as well.

Complaints of sexual harassment that meet the definition under federal Title IX regulations will be addressed through the District’s Title IX grievance procedures. Other complaints of unlawful discrimination, harassment, intimidation, bullying, or sexual harassment that do not fall under federal Title IX will be investigated under the UCP.

The UCP also shall be used for allegations of a violation of specific federal and state programs that use categorical funds, such as Adult Education, Career Technical Education, Child Care and Development, Nutrition Services, School Facilities, and Special Education. The Board encourages the early, informal resolution of complaints at the site level whenever possible.
